Why mediation?
Workplace disputes are unique. Employers and employees often have quite different interests and perspectives with regard to their workplace relationship and issues that arise out of it. When workplace issues rise to the level of legal claims or lawsuits they can be economically and emotionally draining for all parties involved. The mediation of these disputes allows the parties an open, confidential, and interactive opportunity to resolve their workplace dispute.

When should I mediate?
The timing of a mediation conference is ultimately a question for the parties to determine. Courts often require the parties to mediate a dispute before the actual trial of the case. It can also be beneficial early on in a matter even before a lawsuit is filed for the parties to meet in a confidential setting and attempt to resolve the parties’ dispute early and prior to the expenditure of substantial time and expense.

“David was great at helping us resolve our case through mediation”
David mediated an employment case for us that was highly complex and in which both sides had strong opinions about the righteousness of their respective legal positions. I was impressed with how David spent the time and effort to understand each side’s point of view and then work with the parties to find a common ground for resolution.
David worked hard to get both sides to consider the claims at issue objectively and then see the propriety of resolution. Everyone knew going into mediation that It was a tough case to settle but David did it!
